In Season 5's "About Face" (S5E17), criminal Tesla Suskavcevic (James Logan) opens fire on Jimmy Palmer (Brian Dietzen) with a [[Desert Eagle]] sporting a stainless steel finish.  Oddly, when Tesla is confronted at the end of the episode, his gun is a [[Jericho 941]], or "Baby Eagle."  Aside from the possibility that he owns two pistols, it is also possible that the Desert Eagle that appears in Jimmy's memory is a trick of his imagination, making the gun he saw appear much bigger than it really was.  This is consistent with the theme of the episode, emphasizing how shaken Jimmy is after being shot at.

It is presumed that a different M40A1 then that currently in Gibbs' basement was used by him to avenge the murder of his wife and daughter. NCIS is an American crime procedural series that centers around agents of the Naval Criminal Investigative Service investigating criminal cases involving military personnel in the US Navy and Marine Corps. The series is a spinoff of the series JAG, with most of the characters being introduced in the JAG Season 8 episodes "Ice Queen" and "Meltdown". Created by Donald P. Bellisario (Magnum P.I.), the series (which originally was titled Navy NCIS in order to differentiate itself from the CSI franchise) premiered as a weekly show on CBS in September of 2003 and continues to air original episodes on the network. The series' current cast includes Gary Cole, Sean Murray, Rocky Carroll, and David McCallum.

NCIS would itself spawn several spinoff series: first in 2009 with NCIS: Los Angeles (whose characters were introduced in the NCIS Season 6 episodes "Legend Part I" and "Legend Part II") and then in 2014 with NCIS: New Orleans (whose characters were introduced in the NCIS Season 11 episodes " "Crescent City, Part I" and "Crescent City, Part II") as well as in 2021 with NCIS: Hawai'i.

The show also resulted in the first non-US-based TV series with NCIS: Sydney, which premiered in both in Australia and North America in November 2023.
